OVERVIEW

Welcome to Betty’s Retro Shades (“Betty’s Retro Shades”, “we”, “us”, “our”). We operate this online store and website, including all related information, content, features, tools, products and services (the “Services”). The Services are powered by Shopify.

These Terms of Service (the “Terms”), together with our Privacy Policy and Returns & Refunds Policy, govern your access to and use of the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

SECTION 1 – ACCESS & ACCOUNT

By using the Services, you represent that you are at least the age of majority in your state or territory of residence, and you consent to allow any of your minor dependants to use the Services on devices you own or manage.

You may be asked to provide certain information (e.g., email, billing, payment and shipping details). You warrant that all information you provide is accurate, current and complete, and that you have the right to provide it. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must not transfer or assign your account.

SECTION 2 – OUR PRODUCTS

We try to display products as accurately as possible, but colours and appearance may vary due to device settings. Product descriptions, images, and availability are subject to change without notice. We may limit quantities to any person, household, region or jurisdiction at our discretion.

To the extent permitted by law, we do not warrant that any product will meet your expectations. Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).

SECTION 3 – ORDERS

Your order is an offer to buy. We may accept or decline any order at our discretion. Orders are accepted once payment is processed and we send an order confirmation. Please review your order carefully before submitting—cancellations may not be possible once accepted. If we decline or cancel, we’ll use the contact details provided to notify you where reasonable.

Purchases are for personal/household use only and not for resale or export. Returns and exchanges are governed by our Returns & Refunds Policy.

SECTION 4 – PRICES, TAXES & BILLING

Prices are shown in AUD and, unless stated otherwise, include GST where applicable. Prices, discounts and promotions may change without notice. The price charged will be the price at checkout and in your order confirmation, plus applicable shipping and handling.

You agree to provide current and accurate purchase and payment information and to promptly update your details. You represent that you are authorised to use the payment method, and you agree to pay all charges incurred, including applicable taxes and shipping. Your card issuer or payment provider may apply currency conversion fees if you pay from outside Australia.

SECTION 5 – SHIPPING & DELIVERY

Delivery timeframes are estimates and not guarantees. We are not responsible for delays outside our control (e.g., carrier delays, customs). Title to products passes to you on full payment; risk of loss passes on delivery. Please inspect parcels on arrival and contact us promptly regarding any transit damage (see our Returns & Refunds Policy).

SECTION 6 – INTELLECTUAL PROPERTY

The Services and their contents (including trademarks, logos, text, images, graphics, video, audio and the selection and arrangement thereof) are owned by Betty’s Retro Shades or our licensors and are protected by Australian and international intellectual property laws. You may use the Services for personal, non-commercial purposes only. You must not copy, distribute, modify, create derivative works of, publicly display or exploit any part of the Services without our prior written consent.

Betty’s Retro Shades names, logos and product names are our trademarks. Shopify’s names and logos are trademarks of Shopify. Other names and logos are the property of their respective owners.

SECTION 7 – OPTIONAL THIRD-PARTY TOOLS

We may provide access to tools or features offered by third parties “as is” and “as available” without warranties or endorsements. Your use of such tools is at your own risk and subject to the third party’s terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to third-party websites or content. We do not control and are not responsible for third-party materials. Accessing them is at your own risk. Please review applicable third-party terms and policies.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Betty’s Retro Shades is powered by Shopify, but sales are made directly between you and Betty’s Retro Shades. Shopify is not responsible for your purchases or any related claims. You expressly release Shopify and its affiliates from claims arising from your transactions with us.

SECTION 10 – PRIVACY

Your personal information is handled in accordance with our Privacy Policy. Because the Services are hosted by Shopify, certain personal information is also processed by Shopify—see Shopify’s Privacy Policy for details.

SECTION 11 – FEEDBACK & REVIEWS

If you submit ideas, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish and display such Feedback for any purpose. You represent that you have rights to the Feedback and that it complies with applicable laws and these Terms. We may monitor, edit or remove Feedback that we consider objectionable or unlawful.

SECTION 12 – ERRORS & OMISSIONS

Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions (e.g., product descriptions, pricing, shipping charges, transit times, availability). We may correct or update information and cancel orders if information is inaccurate, without prior notice, to the extent permitted by law.

SECTION 13 – PROHIBITED USES

You must use the Services lawfully. You must not, among other things: violate laws; infringe IP rights; harass or harm others; submit misleading information; transmit spam, malware or viruses; scrape or crawl; attempt to gain unauthorised access; or interfere with security features. We may suspend or terminate access for violations.

SECTION 14 – TERMINATION

We may suspend or terminate your access to the Services at any time at our discretion, without notice. You remain liable for amounts due up to the date of termination. Sections intended to survive termination (including Intellectual Property, Feedback, Disclaimers, Liability, Indemnity, Severability, Governing Law and Assignment) will continue to apply.

SECTION 15 – DISCLAIMER OF WARRANTIES

Except as required by law or expressly stated by us, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure or error-free.

ACL carve-out: Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies you may have under the Australian Consumer Law.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Betty’s Retro Shades and our officers, employees, contractors and licensors will not be liable for any indirect, incidental, special or consequential loss, lost profits, lost data, or replacement costs arising from your use of the Services or products. Our total aggregate liability for any claim is limited to the amount you paid for the product giving rise to the claim, except where prohibited by law.

Nothing in these Terms limits liability where such limitation is not permitted under the ACL.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Betty’s Retro Shades, Shopify and our respective affiliates, officers, directors, employees and agents from any losses, liabilities, damages and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of law, or your misuse of the Services.

SECTION 18 – SEVERABILITY

If any provision of these Terms is held unlawful or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.

SECTION 19 – WAIVER & ENTIRE AGREEMENT

Our failure to enforce any right is not a waiver of that right. These Terms, together with policies posted on the Services, are the entire agreement between you and us and supersede prior agreements relating to the Services.

SECTION 20 – ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

Headings are for convenience and do not affect interpretation.

SECTION 23 – CHANGES TO THESE TERMS

You can review the current version of these Terms at any time on this page. We may update these Terms by posting changes on the website. Where required by law, we will provide notice of material changes. Your continued use of the Services after changes take effect constitutes acceptance.
